After you die, when your kids want to open your safety deposit box, who can sign? In order to sell your home after you die, the deed will need to be signed. Who will sign it? There will be no problem if your youngest daughter moves into the house and lives there for years, until she tries to sell it. No matter who lived in the house, or for how long, the title company will see your name on the deed, and they will ask for you to come and sign the deed. Of course you are dead and not signing a lot of deeds. Your kid is going to argue that she has lived in the house and it's hers. She may even produce a will which says she gets the house. However, she isn't going to be able to have her signature accepted by the title company. For sure, the buyer shouldn't let her get away with signing the deed. She is going to have to prove that the will she has is your real last will and testament, when she finally gets in front of the probate judge. Just having her say that the will is your real will won't satisfy the probate court. The probate court will demand proof. She will have to prove that you didn't have any creditors or at least that your creditors have been paid off. Your daughter must find all of all of your creditors and notify them. The judge will authorize your daughter to sign your name on the deed to make the transfer. The buyer has good title to the property, even though your signature isn't actually on the deed, because the title company has recorded the letters testamentary with the title in order to establish the public record that the probate has transferred the title. A durable power of attorney is basically a fill in the blank form document for estate planning every individual's estate plan has to include. When the individual has an accident, gets sick or otherwise goes down, the durable power of attorney allows someone else to take over management of the individual's assets and business affairs. The individual making out the durable power of attorney is called the "principal," and the person who will take over for the principal is called the "agent." A "durable" power of attorney is distinguished from a "general" power of attorney, because it has a provision in it that says that the powers of the agent will endure beyond the incompetency of the principal. Upon a determination that you are incompetent, any general power of attorney you have created will be deemed ineffective. It was finally recognized that the time when a power of attorney was really needed was after the principal couldn't function for himself or herself. Finally, laws were passed which made it so a power of attorney could "endure" after the incompetency of the principal. The use of a will and revocable living trust may be better understood, but don't dismiss the significance of a durable power of attorney. You are more likely to be rendered incompetent and unable to manage your financial matters than you are to die within the next few weeks. It is usually harder, from a legal standpoint, to take over a person's financial life and have them declared incompetent than it is to deal with a dead person's assets. Unless there is a durable power of attorney in place, it will be necessary for the court to appoint an agent or "conservator" for someone who has been determined to be incompetent. An important part of the durable power of attorney is the mechanism that will be used to declare the principal incompetent. A properly written durable power of attorney will allow the family to forego any court intervention for the transfer of responsibility to the agent. A principal can usually be declared incompetent, and unable to manage their business or financial transactions, if two doctors sign a statement affirming that the principal is incompetent. Sometimes a combination of clergy, trusted family members, or medical specialists can be used to verify a principal's incompetency. A principal can assure his affairs are properly dealt with, if his durable power of attorney gives the agent appropriate authority. In addition to a principal's financial matters, a durable power of attorney can give the agent authority to oversee the religious, social and medical concerns of the principal. When a durable power of attorney only deals with medical issues, it is called a "medical durable power of attorney." You can have a single document that includes the medical power of attorney, Health Insurance Portability and Accountability Act (HIPAA) agreement, and living will within your durable power of attorney, or you can keep them all as separate documents. All adult family members need a durable power of attorney, either combined as described above, or in distinct documents. Sign the documents and put them where your family can find them and they will be safe. A durable power of attorney can come to the forefront and save you time, money and aggravation at the time of a family or individual hardship. Without a will, the courts do their best, but I have seen families torn apart when the judge makes his final guardian determination. The kids often end up never seeing most of their family again. I also have couples come in to do their estate planning and they can't ever complete the task, because they can't select guardians for their kids. It is a hard decision. Who desires the kids? Who will best raise your children? Where will your children be raised? Will the kids be treasured? When you do your estate planning, who do you pick as guardians for the children? It isn't easier for the judge, than it is for you. You need to act now to make sure your children are protected by naming guardians for them in your will. If you are a grandparent, you need to make sure your kids do their estate planning or at least have wills that name guardians for the grandchildren. Grandparents need to make sure their kids do their estate planning and name guardians for the grandchildren in a will. I handled one estate planning case where the grandparents wanted to raise their grandchildren after the parents were killed in an auto accident. There wasn't a will. No estate planning had been done.The judge appointed a shoestring relative as guardian. The Court was petitioned by and appointed a distant relative to be guardian. Right after the accident, I got a call from the grandparents to make out a trust and set up their estate plan. Their orphaned grandchildren were to be left with a substantial amount of their estate. I just helped the grandparents update their trusts and wills, after twenty years, and the grandchildren were removed from the list of beneficiaries. It has been twenty years and the grandchildren haven't seen and don't even know their grandparents. After considering who you name in your will, the probate court will decide who to give legal custody and legal authority to raise your children. That person will be the guardian. The court will almost always honor the selection you have made in your will. Ask yourself, "Who and what do I really want for my children's guardian?" This is an important exercise before you start your estate planning or make your will. As you write your will you can "educate" the probate court because you understand what it is you want. Your will should list two or three selections for guardian. When the first selection, for some reason, is unable to serve, then the next in line will serve until one can serve. The court should be tutored with restrictions or things to consider about each selection. The guardians could start to serve many years from now so you have to take that time lag into consideration. For instance, the health of the grandparents could change, so you could restrict their service on the condition of their ability to care for the children. The condition, that the aunt or uncle is still happily married to their same spouse, protects the children. The guardians could be restricted by the judge to raise the children in your family home, or have them raised in a specific religion, if you ask for it. The judge would appreciate any help you give the court. Lawyers seldom put restrictions like these in a will; it isn't worth their time.
