The Process of Hiring a DUI Lawyer

The top three mistakes that people make when they get arrested for a DUI or DWI violation are:

1. Assuming that the outcome of a court case is predetermined by field tests

2. Overlooking the act or requesting a hearing with the DMV

AND MOST IMPORTANTLY!

3. Failure to consult a licensed DUI lawyer

You see, the first two mistakes can easily be overcome if you at least consult with a DUI lawyer instead of listening to all the unqualified advice you’ll get from friends, family and even the police themselves. Laws that concern DUIs or DWIs and those which govern DMV operations are nothing short of a labyrinth of information. Only someone who specializes in this kind of DUI legal defence would know where to start. That is why you need to specifically find a DUI lawyer and not just any criminal lawyer.

Here’s how you go about hiring one:

First, do some research and interview a couple of DUI attorneys. Don’t just go with the first one you find. The key to getting the best outcome possible from your DUI court case is finding the right lawyer/firm who knows what they are doing and takes up your case as if it were their very own.

Second, do even more research. Ask the DUI lawyer what kind of questions you should expect from the prosecutor and ask him to give you an honest and professional opinion on all the possible outcomes of the court case, whether good or bad. Make sure you find out what will happen to your license as well. Is there a way to keep it from being suspended or revoked? Cover all bases. More often than not, a good DUI lawyer will even tell you these things in advance because you may not know all the legalities involved in such a case.

Third, get your agreement in writing. Although we may want everyone to be honest, it isn’t always possible. There are many cases of clients who made the old “handshake” agreement with a DUI lawyer and agreed upon, say, $2,000 for the services offered. Thereafter, the case went to trial and the lawyer demanded more money which the client has no choice but to pay, whether to the same or another DUI lawyer. A written agreement or contract ensures that you and lawyer have a reference which keeps everything in perspective. It details whether your lawyer is expected to handle both the DUI and license suspension cases, how much he will be charging and the name of the lawyer who will be handling the case. Again, there is a lot of frustration coming from clients who spoke to top lawyers during negotiation then got stuck with their assistants at court cases.

Don’t allow a DUI lawyer to smooth talk you or confuse you with difficult words. It doesn’t matter how well he says he knows the judge or prosecutor. His skills need to be impeccable and he needs to maintain professionalism all through.
