The Benefits Of Trademark Registration

By: YAZAR GUN

If you run a business, then it is advisable to go for registration of your trademark. Of course, your trademark registration is not mandatory. However, there are many benefits of registering your trademark. No doubt, by doing so, you are better off than those businesses that do not have trademark registration.

If you happen to be a business owner, or else working with a business with no business registration, then you need to register your trademark for your benefits. The same is true for business that is awaiting its response from the TPE. It is surprising that there are many businesses that do not apply to the TPE for trademark registration. This makes the business at a disadvantage compared to that which has its own trademark.

Having a trademark makes your position in the business market well-established. If it is found that another business is trying to infringe upon your brand name, you can confidently take legal action. By trademark registration, a business makes its trademark name individualized publicly. The business makes it sure that no other business interferes with your clientele by using your trade name and confuses the customers. There have been a number of cases like the previous scenario and there were legal wrangles among the rival business units sort out the original owner of the trademark. This could well have been avoided if an appropriate action were taken to register the trademark.

A product or business name that has a small R next to the word signifies registration. However, there are more to it than simply registration. The symbol ® next to the name, logo or slogan signifies "registered trademark" and the registration has taken place with the Turkish Patent and Trademark Office or TPE.

It is beneficial to the business to register your trademark with the TPE as it tells publicly that you have the exclusive rights for that brand name within the ambit of that industry. Hence, if at a later stage, it is found that some other business is using similar name or logo as yours, you have all the legal rights to move court and stop the other business from using the word in its business.

Whenever, an individual applies to the TPE for trademark, the authority there conducts a cross reference check and tries to find if any other individual has registered similar trademark of the name or design or if their registration is pending before the federal agency. This way, you are free from the danger of another business utilizing and damaging the goodwill that your company has built through hard work over the period.

It needs mentioning here that the TPE considers the trademark application pending for around 18 months and hence, the sooner it is applied, the better and faster it is for you to get the trademark registered and conduct business under registered and protected name.
