Revealed- The Truth About Divorce

By: Gen Wright

In as much as any couple who enters into the commitment of marriage would like to keep it forever, there are some circumstances which result into the breaking of the knot. Certainly, nobody wants to go through divorce procedures. Aside from the fact that divorce implies financial obligations, it is also a tough and painful process. However, it is a fact of life that people will have to deal with. As such, it is important for one to be politically informed on the bearings of divorce.

Although divorce laws significantly vary around the world, the end result of all these laws is still the dissolution of marriage. Technically speaking, divorce is the final termination of marriage, thus canceling the marital status of the interested parties. In most cases, the divorce process requires the assistance of a lawyer and requires the sanction of a judge.

There are different types of divorce. One of these is no-fault divorce which does not require for any party to be at fault in order for the marriage to be dissolved. This is probably the easiest and the most convenient type of divorce. In the United States, around forty nine states adopt no-fault divorce laws.

Another type is summary divorce. This type of divorce is filed when partners fall short of legitimate requirements of marriage. Some of these include not having any children, minimal or no property, and short marriage among others. Couples can also agree on some key issues that will be used as grounds for filing a divorce.

Uncontested divorce is another type of divorce wherein both parties are able to come up with an agreement on issues concerning the children, properties, and support issues with or without the assistance of lawyers or mediators.

On the other hand, collaborative divorce is one of the most popular types of divorce today. In this process, both parties are given the freedom to come up with an agreed resolution with the assistance of a neutral financial specialist and lawyers who specialize in collaborative divorce process. As soon as the parties are able to come up with their decision, and the divorce process starts, the lawyers are not anymore allowed to represent their clients in court proceedings.

Finally, the mediated divorce provides a different method of the divorce procedure. In the mediated divorce type, all efforts are directed toward mending up differences and trying to make things works. As such, a mediator assists in the process by providing information and suggestions of solutions to both parties. Mediation is less costly than litigation that is why more couples are opting for this type. Lawyers and legal counselors are not necessarily required during the mediation process, but is it more practical to solicit for the services of lawyers to act as mediators.
