Reglan Lawsuits

Patients and families throughout the country have recently investigated filing a Reglan lawsuit based on the serious side effects from Reglan or being part of a Reglan class action lawsuit. Only recently has the public become aware of the association between Reglan drug side effects following long-term use and the symptoms that many people have been suffering from, but did not relate to the Reglan medication. Currently claims are being filed individually on behalf of people who have suffered from tardive dyskinesia side effects of Reglan. There currently is no cure for tardive dyskinesia.

On January 26, 2009 the FDA issued an alert warning against chronic use of metoclopramide containing drugs and requiring a boxed warning due to Reglan effects which are often similar to Parkinson’s symptoms. Consumers have looked a filing a Reglan lawsuit based on the argument that the manufacturers failed to properly warn of the potential serious tardive dyskinesia symptoms that can develop after extended use of the drug.

The Reglan lawsuits claim that the various metoclopramide drug manufacturers were negligent in several ways including but not limited to:

• Represented that Reglan caused minimal side effects of knowing that the drug causes central nervous system side effects like tardive dyskinesia far more frequently than represented
• Had actual knowledge through both their own studies and independent studies, that doctors frequently prescribed Reglan for long term use that was not safe for patients
• Had actual knowledge that the risk of tardive dyskinesia and other side effects of Reglan in patients who received the drug for 12 weeks or longer is approximately 100 times greater than disclosed in packaging inserts for Reglan and the Physicians Desk Reference label for the Reglan brand metoclopramide.
• Failed to investigate the accuracy of its Reglan label once it became aware of signals indicating a safety issue
• Failed to monitor all relevant scientific literature related to Reglan
• Failed to conduct and report post market safety surveillance on Reglan
• Reglan was not reasonably safe as designed because the foreseeable risks involved in its use outweighed the therapeutic benefits of the drug

It is recommended that treatment not exceed twelve weeks, however it is estimated that around thirty percent of patients who are prescribed products containing metoclopramide take the medication for a much longer period of time.
